Background
The claim arises from an incident where our client was attacked by a ram while visiting a farm property.
Circumstances of the Injury
Our client and her friend at the permission of the property owners had moved a caravan onto the farm land. While exploring the property, our client encountered a ram and patted it. The ram then followed her and attacked her, causing her to fall to the ground. The ram continued to headbutt her while she was on the ground, resulting in her sustaining significant upper body and facial injuries.
Injuries and Treatment
As a result of the attack, our client suffered a wrist fracture, facial lacerations and scarring, a broken nose, and a bruised and swollen face and an eye injury. She underwent surgery on her eye and wrist.
Liability
The property owner breached its duty of care by failing to warn our client about the aggressive ram, failing to restrain the ram, and as such they failed to take reasonable care to avoid foreseeable risks of injury to visitors to the farm land.
Quantum
Our client obtained a substantial award of damages.
