Nina talks Divorce

Seeking expert advice early can significantly help your chances of having a more quick and smooth divorce.

The circumstances of each separation are unique.  This means that there is no one-size-fits-all answer to the question of how long the divorce will take to resolve.

There are many considerations which impact how long the legal process will take, and no two matters are exactly alike.  For example, if a matter involves both parenting and property considerations, it may be more involved and thus take more time than a matter involving just one of those considerations.

Further, as lawyers, we have no control over Court scheduling, and if a litigation matter does not resolve and runs to trial, it is likely to be in the Court system for in excess of one year before a trial is reached.  There may then be a further delay between the conclusion of the trial and judgment being handed down.

We also cannot control the actions of third parties including, for example, how long they will take to respond to correspondence, whether they will accept proposals for resolutions, and so forth.

All that being said, we always try to resolve things as expediently and cost-effectively as possible, as we know it is important for our clients to be able to put what is often a very stressful matter behind them, and move on with their lives.  This is why, if circumstances allow, we like to resolve matters without resulting to litigation, such as through Consent Orders.

Being realistic with negotiations and notifying the other side as to the time and cost of litigation may help expedite resolution.

We may be able to give you a more realistic estimate as to how long the process could take once we have particulars of your matter, so we encourage you to get in touch and speak to one of our Family Lawyers.
