Tiffany Laslett

looking through a rear view mirror view at a car that has been in an accidentOur client was 42 years of age when she was injured in a motor vehicle accident in 2010.

Her car was stationary at traffic lights, waiting for the light to change from red to green, when another vehicle suddenly rammed into the back of her car, at approximately 80 km/hr, forcing her car into the intersection.

She suffered injuries to her neck, with radiating symptoms into her left arm as well as an injury to her upper back.

She struggled to return to her career as a hairdresser given the need to stand in one position for long periods of time with her arms outstretched at around shoulder height and perform repetitive duties.

At the time the accident occurred, she was in the process of establishing a new business and therefore her income in the period leading up to the accident was not substantial.

It was clear however that her ability to return to work as a hairdresser in future would continue to be affected in the long term.

The insurer failed to make a reasonable offer at settlement negotiations and the claim was therefore listed for trial.

With detailed documentary evidence regarding her business plans, and persuasive medical evidence, we were eventually able to persuade the insurer to increase their previous offers and a settlement was reached for over $300,000.00 plus legal costs and disbursements.
