Martin Faull talks financial settlements after separation
A commonly asked question is what happens to our property when we get divorced.
The answer is technically nothing. Divorce is unrelated to property settlement. You can only become divorced after you have been separated for 12 months.
You can affect a property settlement any time after separation, but to be safe, you should issue property settlement proceedings within 12 months of your divorce, given there is a time limitation relating to property settlement following divorce.
