What is a personal injury legal claim?

In law, the term personal injury usually describes an illness or injury that was caused by someone elseFor example, you were injured in a car accident because another car hit yours. Or you were injured when you slipped and fell on a puddle of water at your local shopping centre.

You can make a legal claim with the help of your personal injury lawyerYou can seek money, payment of medical expenses, or other types of compensation.

The cost of personal injuries

A personal injury can cause financial hardship, including decreased income if you’ve stopped work. Medical bills pile up. Perhaps you need to replace your car. You’ve reorganised your life. Maybe also your family’s life. There are other costs you didn’t consider, for example, help with housework and transporting your kids. Even dog walking.

Personal injury compensation claims can help relieve the stress. When handled effectively, your payout takes many of these issues into account.

Frequently asked questions about personal injury claims

  • How long do I have to make a personal injury claim?

If you’ve suffered a personal injury, there’s usually a time limit for making a legal claimMaking a legal claim is sometimes referred to as starting court proceedings or commencing court proceedings.

Often, the law requires you to claim within three years after you were injured.  If you were injured as a child (under the age of 18), you have until your 21st birthday to make a claim.

This is often known as the limitation period. Courts are usually very strict about making claims within the right time. Occasionally, a court will allow a claim when it’s filed outside the limitation period, but this is rare.

For injuries caused by faulty products, the limitation period is much shorter but will depend on the injuries and the nature of the product’s defects.

If you’ve suffered an injury, our best advice is to see a personal injury lawyer as soon as possible. Even if you think the limitation period may have passed, you should get legal advice to make sure you’ve explored all your options.

  • If I make a personal injury claim, do I have to go to court?

Personal injury claims are also known as court proceedingsWhen you make a claim, what you’re really doing is giving notice to court (and to the other party) that you’re making a claim. It doesn’t mean that you must have a trial at court to decide whether you’re entitled to any money. It means that you have the option (or the right) to do so.

Most personal injury claims settle before going to trialFor example, this can happen when your lawyer negotiates with the other party (often an insurer).

Settling a personal injury claim often avoids much stress, time and expense, although it’s not the best fit for every situation. We’ll discuss this with you at your free first appointment.

  • How much money can I claim for my personal injury?

There are many things which influence how much compensation you might receive for a personal injury. For example:

    • When you were injured
    • How you were injured
    • The type of injury (for example, motor vehicle accident or workplace injury)
    • Any laws that apply to your injury
    • The severity of the injury
    • Whether you had any other medical conditions at the time you were injured
    • Whether your injury will affect you for a long time

With so many factors, it’s impossible to say how much money you’d receive, but we can give an estimate once we understand your injury and all the circumstances. We’ll start this process at your free first consultation.

Get in touch today to find out more about your personal injury claim.

  • What are damages?

In injury claims, damages are the amount of money awarded to you, to be paid by the party who caused the injury (or by their insurer). When damages are calculated, the aim is to try to put you back in the position you would have been in were you not injured.

While no amount of money will ever compensate for permanent injury or loss of health, it’s an attempt by the legal system to make things right. And it’s certainly better than no money at all.

Get in touch today to find out more about your personal injury claim.

  • What is compensation?

Compensation is a payment for expenses or lost income or any other financial loss that you’ve suffered because of your injury. Often, compensation is also available for other things that aren’t as easy to calculate, such as pain and suffering.

In personal injury law, compensation can be paid for:

    • Pain and suffering
    • Loss of income and superannuation
    • Loss of future income and future superannuation
    • Past and future medical expenses
    • Past and future assistance with personal care and household jobs
    • Equipment and home modifications
    • Interest on damages
    • Loss of enjoyment of social and recreational activities

Working out compensation is a careful process. You’ll need specialised legal advice, especially when assessing your future needs and expenses. We’ll help you
