  • How long do I have to make a personal injury claim?

    If you’ve suffered a personal injury, there’s usually a time limit for making a legal claimMaking a legal claim is sometimes referred to as starting court proceedings or commencing court proceedings. 

    Often, the law requires you to claim within three years after you were injured.  If you were injured as a child (under the age of 18), you have until your 21st birthday to make a claim. 

    This is often known as the limitation period. Courts are usually very strict about making claims within the right time. Occasionally, a court will allow a claim when it’s filed outside the limitation period, but this is rare.  

    For injuries caused by faulty products, the limitation period is much shorter but will depend on the injuries and the nature of the product’s defects.
